These Terms & Conditions (the “Terms”) govern your use of and access to www.failureisanoption.com, its sub-domains, and Failure Is An Option, LLC’s (“we”, “us” or “our”) pages and accounts on Instagram®, Facebook®, X®, and LinkedIn®, (collectively, the “Sites”).

By using the Sites, you accept and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must cease using the Sites immediately.

Unless otherwise noted, the Sites and all content therein—including graphics, text, design, logos, slogans, and organization—are the sole property of Failure Is An Option, LLC and are protected by copyright, trademark, and other intellectual property laws.

• Limited License: You are granted a non-exclusive, non-transferable, revocable license to access the Sites for personal, non-commercial use.

• Restrictions: You may not reproduce, distribute, or create derivative works from our content without express written permission.

2. PROHIBITED CONDUCT

You agree not to use the Sites to:

• Violate any local, state, or international laws.

• Engage in any scraping, data mining, or automated harvesting of content.

• Transmit any viruses, malware, or malicious code.

• Harass, abuse, or defame other users or the company.

• Impersonate any person or entity, including Mike Grossman or any Failure Is An Option, LLC representative.

• Copy, distribute, or create derivative works from our text, graphics, or book excerpts for commercial use without our express written permission.

3. E-COMMERCE & FRAUD PROTECTION

We reserve the right to refuse or cancel any order for any reason, including suspected fraud, unauthorized activity, or pricing errors. If your order is canceled after your payment has been processed, we will issue a full credit to your original payment method.

4. DISCLAIMER OF WARRANTIES

THE SITES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. FAILURE IS AN OPTION, LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SITES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

5. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAILURE IS AN OPTION, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE SITES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THE SITES SHALL NOT EXCEED THE AMOUNT PAID BY YOU, IF ANY, TO ACCESS THE SITES.

6. CHANGES TO THIS AGREEMENT

Failure Is An Option, LLC reserves the right to modify these Terms and Conditions at any time. We do so by posting and drawing attention to the updated terms on the Sites. Your decision to continue to visit and make use of the Sites after such changes have been made constitutes your formal acceptance of the new Terms and Conditions.

Therefore, we ask that you check and review this Agreement for such changes on an occasional basis. Should you not agree to any provision of this Agreement or any changes we make to this Agreement, we ask and advise that you do not use or continue to access the Failure Is An Option, LLC site immediately.

7. DISPUTE RESOLUTION (ARBITRATION & CLASS ACTION WAIVER)

Any dispute arising out of these Terms shall be resolved through binding arbitration in Santa Clara County, California, rather than in court. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

8. GOVERNING LAW

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any legal action not subject to arbitration shall be filed in the state or federal courts located in Santa Clara County, California.
